1. Acceptance of Terms

By installing and using SmartTab ("the Extension"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, please do not use our Extension.

2. Description of Service

SmartTab is a browser extension that:

• Saves and organizes your browsing history locally
• Provides search functionality for your saved history
• Offers favorites and organization features
• Manages tabs and recently closed pages

The free version is limited to 25 unique website domains. The full version removes this limitation.

3. Privacy and Data

Your privacy is paramount:

• All browsing data is stored locally on your device
• We do not collect, transmit, or have access to your browsing history
• Optional Chrome Sync only syncs favorites through Google's secure infrastructure

4. License and Usage

Grant of License

We grant you a personal, non-transferable, non-exclusive license to use SmartTab on your devices.

Restrictions

You agree not to:

• Reverse engineer, decompile, or disassemble the Extension
• Modify, adapt, or create derivative works
• Use the Extension for any unlawful purpose
• Redistribute or resell the Extension or its license
• Remove any proprietary notices or labels

5. Purchases and Subscriptions

Payment Processing

All payments are processed securely through ExtensionPay. We do not store payment information.

Subscription Terms

• Monthly: Automatically renews each month
• Yearly: Automatically renews each year
• Lifetime: One-time payment, no renewal

Cancellation

You may cancel subscriptions anytime through your ExtensionPay account. Access continues until the end of the billing period.

6. Intellectual Property

SmartTab and all related trademarks, logos, and content are the property of SmartTab. These Terms do not grant you any rights to use our intellectual property except as necessary to use the Extension.

7. Disclaimers and Limitations

No Warranty

SmartTab is provided "AS IS" without warranty of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation of Liability

In no event shall SmartTab be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business interruption.

Maximum Liability

Our total liability shall not exceed the amount you paid for the Extension in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless SmartTab from any claims, damages, losses, and expenses arising from your use of the Extension or violation of these Terms.

9. Modifications

To the Extension

We may update SmartTab with new features, bug fixes, or improvements. Major changes will be communicated through extension updates.

To the Terms

We may modify these Terms at any time. Continued use after changes constitutes acceptance of the modified Terms.

10. Termination

These Terms remain in effect until terminated. You may terminate by uninstalling SmartTab. We may terminate or suspend access for violations of these Terms.

11. Governing Law

These Terms shall be governed by the laws of the European Union and the Netherlands, without regard to conflict of law provisions.

12. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms constitute the entire agreement between you and SmartTab regarding the use of the Extension and supersede all prior agreements.
